January 1st, 2026 marks the start of one of the biggest advancements in 2nd Amendment rights in close to 100 years. $200 tax stamps on NFA items are going away! This applies to Suppressors as well as SBRs/SBSs. 

With this change coming up fast, the ATF has put out a notice there will be an eForms processing blackout from December 26th – January 1st while they update their systems and processes to accommodate the “new norm”.

Here’s what you need to know if you are thinking about purchasing a silencer or SBR from Griffin Armament!

  • All eForm submissions and certifications will pause starting December 26th. There will be no movement on any pre-submitted forms until January 1st. 
  • Any form submitted prior to December 26th, will be put on hold until January 1st. 
  • Draft forms that remain unsubmitted by December 26th will be deleted, and will need to be started fresh again after January 1st. 
  • Expect a surge of new and backlogged submissions starting January 1st, potentially increasing wait times in the early new year.

 

Per the ATF eForms website, 

“This is necessary to implement statutory changes contained within the One Big Beautiful Bill Act, which reduced the making and transfer tax for certain firearms to $0. Deletion of all Draft applications is necessary because of the field and formatting changes required on new forms, available January 1, 2026. This will also allow ATF to add additional functionality to the Form 4, allowing both qualified licensees as well as other transferors to submit Form 4 applications through the eForms system. Photographs, fingerprints, and Chief Law Enforcement Officer (CLEO) notifications will still be required on January 1.”

 

So, what does this all boil down to?

If you currently have a draft form in process, COMPLETE IT ASAP! If it remains unsubmitted on December 26th, you will have to start the whole submission process over again. The ATF has stated that any forms submitted by midnight on 12/25, will be approved or denied by December 30th, to clear out the system.

Please defer to Capitol Armory or your local dealer for more information on Form 4 processing, but expect that any NFA order placed from December 23rd – January 1st will NOT be submitted to eForms until January 1 to avoid denial and deletion of the form during the blackout

Final Thoughts

The 2nd Amendment is very broad for a reason, and we believe that being properly kitted is essential to maintaining the definition of “a well-regulated Militia”. Suppressors have become ubiquitous not only as a safety feature, but as modern technology that is intentionally covered under this all-important Amendment. There is still more that can be done, which is why Griffin is continually committed to using our resources to further de-regulate Suppressors and SBRs.
